What Constitutes Harassment in the Second Degree in New York?

The elements of harassment are listed in New York Penal Code § 240.26. Broadly, a person commits a violation when they engage in specific conduct against another person and their intent is to harass, annoy, or alarm them.

The law further breaks the offense down into three subsections, each specifying different acts that may be considered harassment.

These include:

  • Striking, shoving, kicking, or physically contacting a person in some way, or making a threat to commit any such acts.
  • Following someone in or on a public location.
  • Committing multiple or repeated acts against someone in a way that alarms or seriously annoys them. Additionally, the conduct serves no legitimate purpose, meaning the only reason one would engage in it would be to threaten, intimidate, or coerce someone.

Is Harassment in the Second Degree a Misdemeanor or Felony in New York?

Second-degree harassment is neither a misdemeanor nor a felony. Instead, it is a violation.

Under New York law, a violation is not considered criminal. A crime is defined as a misdemeanor (an offense punishable by up to 1 year in jail) or a felony (an offense punishable by more than 1 year in prison). Harassment is a felony or misdemeanor only when it is charged as aggravated harassment in the second degree (class A misdemeanor), first-degree harassment (class B misdemeanor), or aggravated first-degree harassment (class E felony).

Generally, when someone is accused of second-degree harassment, they will be issued a summons or Appearance Ticket as opposed to being arrested.
