Criminal Mischief Defense
A criminal-mischief allegation requires careful review of the charged theory, property rights, mental state, damage and identity. Preserve photographs, original recordings, repair documents and court papers. Lebedin Kofman LLP can assess the allegation and the next deadline with you.
What Prosecutors Must Prove
The prosecution must establish intentional damage to another person’s property, without a right or reasonable ground to believe there was a right, plus one of two statutory alternatives:
- Damage exceeding $250.
- Damage to another person’s locked motor vehicle by breaking into it intending to steal property, together with at least three qualifying criminal-mischief convictions within ten years, arising from separate transactions and separately sentenced.
One prior conviction alone does not satisfy the vehicle alternative. Neither does a generic assertion that the property belongs to a protected category.
Every required element and the accused person’s commission of the offense must be proved beyond a reasonable doubt. Read the complaint or indictment rather than treating the offense title as the complete accusation.
How This Charge Can Come Up
An invoice for $300 is not self-proving: counsel should compare the claimed damage with pre-incident photographs, the actual repair scope and supporting evidence. In a locked-vehicle allegation, the prosecution must establish the required break-in, theft intent and qualifying conviction history if relying on that alternative.
These are hypothetical proof issues, not reported firm results or predictions. Preserve the full sequence and explain what happened before and after the alleged damage.
Defense Issues
Under Penal Law 145.13, property of another includes property in which another person has an ownership interest even if the accused is a co-owner. Shared ownership is therefore not an automatic defense. Counsel should distinguish ownership from actual permission and from a reasonable belief in a right to act.
- Does the evidence identify who caused the particular damage?
- Does it establish the charged mental state rather than a simple accident?
- Do photographs and repair evidence separate new damage from pre-existing defects?
- Are statements, searches and digital evidence lawfully obtained and reliably preserved?
For the value-based charges, the amount must be supported, not inferred from the cost of replacing undamaged property. For an emergency-equipment or explosive allegation, test that distinct statutory theory. Do not delete messages or contact a protected person to negotiate a private resolution.
Sentencing and Collateral Consequences
Class E felony. The ordinary class E felony maximum under Penal Law 70.00 is four years. Eligibility for a particular sentence and the effect of prior convictions require an individual sentencing analysis; there is no universal one-to-three-year sentence.
Counsel should assess restitution, release conditions, any order of protection, and potential employment, licensing or immigration consequences. Paying for damage does not itself require the prosecutor to dismiss the criminal charge. Any proposed disposition should be reviewed before accepting it.
Evidence and the next court date
Keep the complete charging document, appearance notice, release conditions, property records, original messages and witness contact information. Identify recordings held by stores, buildings or third parties before retention periods expire. Ask counsel how to transfer sensitive material securely; the website inquiry form is not the place for confidential evidence.
Depending on the case, the next stages may include arraignment, discovery, investigation, motions, negotiations, hearings or trial. Felony accusations can involve grand-jury proceedings. Follow current orders and court dates while counsel assesses the available options; an inquiry does not extend a deadline.

Frequently Asked Questions
Does one earlier criminal-mischief conviction make this third-degree criminal mischief?
Not by itself. The locked-vehicle alternative requires three or more qualifying convictions within the specified ten-year period and the other statutory conditions. The separate damage-value alternative does not require that conviction history.
Is jointly owned property automatically exempt?
No. Penal Law 145.13 includes another owner’s interest even where the accused also has an interest. Actual rights, permission and any reasonable belief must be assessed on the facts.
What should I preserve before the consultation?
Keep court papers, unedited recordings, photographs, messages, ownership or permission documents, repair records and witness details. Ask counsel how to provide them securely and identify your next deadline.
